Argentinean legislators alert of threat to the rule of law

Buenos Aires, Jan 6 (Prensa Latina) The rule of law and the division of powers are under threat in Argentina, legislators from the Frente de Todos (FdT) party alerted.

FdT deputies and senators issued a statement denouncing the violations committed by the Supreme Court of Justice (CSJ), and supported the decision of President Alberto Fernandez and several governors to request a political trial against the members of the Court. They also noted that the supposed independence of the judiciary power and the neutrality of its rulings are questionable.

On Wednesday, Fernandez delivered the petition to the president of the Political Judgment Commission of the Chamber of Deputies, Ana Carolina Gaillard, and to the leader of the FdT bloc in the Chamber, German Martinez. He also asked them to help promote the process in the shortest possible time.

The president and the governors in the said document, assure of the existence of ‘an inadmissible degradation that jeopardizes the republican system of division of powers’.

As stated, this occurred mainly due to actions of the CSJ such as declaring the unconstitutionality of Law 26,088, which had been in force during 16 years establishing the functioning of the Council of the Magistracy.

The CSJ also favored the Autonomous City of Buenos Aires with the increase in co-participating funds and issued a precautionary measure to force the State to pay the said increase to the capital, even though this was not contemplated in the 2023 approved Budget.

It is an anomalous situation in which a State power arbitrarily decides to invade the spheres of competence of the rest, says the statement, which also denounces the coexistence and negotiation between the Court and the Minister of Justice and Security of Buenos Aires Marcelo D’Alessandro.
