The complaint, according to the report, must be filed before the beginning of Carnival 2025 (February 28).
According to the newspaper, the piece should initially point to the accusation that Bolsonaro led a criminal organization, with the aim of staging a coup d’état in the South American nation.
Other investigations, such as those related to the illegal diversion of Saudi jewelry and fraud in Covid-19 vaccination cards, should be treated separately at a later stage.
The indictment is based on the report of the Federal Police (PF), which concluded that Bolsonaro integrated and led a criminal organization aimed at trying to prevent the inauguration of President Luiz Inacio Lula da Silva.
According to the PF, the far-right politician was charged in three different cases, with penalties that can reach up to 28 years in prison in the event of a maximum sentence.
The crimes attributed to the ex-governor are: integrating, promoting or financing a criminal organization (penalty of three to eight years in prison).
Attempting to abolish the democratic rule of law by means of violence or serious threat (punishment of four to eight years).
Attempting to depose, by means of violence or serious threat, a legitimately constituted Government (punishment of four to 12 years).
If the Attorney General’s Office asks for the minimum penalties, Bolsonaro could be sentenced to 11 years in prison.
However, journalist Mônica Bergamo, from Folha de Sao Paulo, states in her article that allies of the former Army captain believe that Gonet will ask for harsher punishments, considering that others involved in January 8, 2023 coup acts were sentenced to up to 17 years in prison.
Thirty-nine other people, including generals, former ministers, businessmen and politicians from the former president’s entourage, were also indicted for the alleged plot in 2022.
