At least six people make up the so-called core group, and this will be the third round of reviewing the complaints.
In February, the Attorney General’s Office (Prosecutor’s Office) charged former President Jair Bolsonaro and 33 other people with the crimes of armed criminal organization; violent abolition of the Democratic Rule of Law and coup d’état; qualified damage to the assets of the Union; and damage to declared property.
In the indictment, the Attorney General’s Office divided the suspects into five core groups. Regarding the plotting, the third was the most recent to have a trial scheduled.
Judges De Moraes, Cármen Lúcia Antunes, Flávio Dino, and Luiz Fux will assess whether the indictment presented sufficient evidence to open a criminal case against the accused, including former presidential advisors, police officers, and military personnel.
For the complaint to be accepted, a majority vote among the five judges is required. If accepted, the accused will be considered defendants and a criminal case will be initiated.
The deadline for final arguments will open later, when defense attorneys can challenge the evidence included by the Attorney General’s Office in the complaint and raise evidence that points to the defendants’ innocence.
Following the arguments, the Supreme Federal Court must set a date for the trial of the accused.
