The former president, sentenced to six years in prison and disqualified for life time from holding public office, launched her provincial candidacy for the 3rd Electoral Section for the elections of next September 7, according to Noticias Argentinas news agency.
The main plaintiff is Daniel Llermanos, who identifies himself as a voter registered in the electoral roll of the 3rd Electoral Section, wo claims that the disqualification of the former president “directly affects my fundamental right to choose the candidate of my preference, restricting the electoral offer and violating my freedom of choice”.
Llermanos maintains that, as a citizen, he has “full exercise of my political rights” and active legal standing to file this injunction.
The filing seeks to suspend any act that prevents his candidacy, derived from the conviction in the case known as “Vialidad”, confirmed by the Supreme Court of Justice of the Nation on June 10, Noticias Argentinas explains.
According to the filing, Cristina Fernández, until now president of the Justicialist Party, although, according to the confirmation of the conviction, she could no longer exercise the position or promote her candidacy for provincial legislator.
Llermanos, a referent of the group “Abogados Solidarios”, bases his filing on Articles 1, 37 and 38 of the National Constitution, which guarantee the right to free suffrage and the exercise of political rights and Article 75, paragraph 22, which grants constitutional hierarchy to international human rights treaties such as the International Covenant on Civil and Political Rights and the American Convention on Human Rights.
Finally, the plaintiff requests a precautionary measure to suspend Cristina’s disqualification allowing her inclusion in the lists of candidates for the September 2025 elections, given the “imminent closing of the deadline for the officialization of candidacies (July 19, 2025)”, Noticias Argentinas reports.
