Argentine lawyer files criminal complaint against president Milei

Buenos Aires, Oct 6 (Prensa Latina) Attorney Gregorio Dalbon filed a criminal complaint against Javier Milei for the alleged crime of abuse of authority, after acknowledging that he was the first Argentine president to decide that Cristina Fernandez should be imprisoned.

Galbon, who was one of the former dignitary’s defense attorneys, addressed the matter last night in an interview with LN+ channel following the resignation of Jose Luis Espert, a national deputy and leading candidate for the La Libertad Avanza party, according to the media outlet Data Diario, which reported the lawyer’s legal action.

Espert resigned amid a serious scandal due to his close ties to a drug trafficker convicted in Argentina and awaiting extradition to the United States, from whom he received numerous favors and even money.

As always, Milei blamed all his and his administration’s hardships on Kirchnerism and his opponents from the Justicialist Party, claiming that his political ally’s debacle was a premeditated operation. In that effort, he said he was the only president to have imprisoned Cristina Fernandez.

For Dalbon, this statement does not constitute a simple political opinion, but rather the “admittance of an illegal act of power” that places the President “above the judges, violating Article 109 of the National Constitution.”

Along these lines, he maintained that the president assumed powers reserved for the judiciary, thus constituting an explicit violation of the separation of powers.

“When Milei says he imprisoned Cristina, he’s admitting something very serious: that lawfare existed, that the persecution was political, and that he endorsed it. He confessed that the judiciary isn’t independent, that Cristina’s imprisonment was political, and that the authorities continue to use the Penal Code as a weapon,” concluded attorney Dalbon.
