Chilean environmental workers reject Kast’s mega-reform

Santiago, Chile, Aug 7 (Prensa Latina) The National Federation of Environmental Workers (Fenatrama) has rejected the mega-reform bill approved by the Chilean Parliament, arguing that it prioritizes business interests and limits communities' access to justice.

The Fenatrama stated that the bill promoted by Jose Antonio Kast’s government failed to incorporate technical observations submitted by the organization and other specialized stakeholders during the legislative debate.

One of the main points of contention concerns the provision that would allow for compensation using public funds to be paid to project developers whose Environmental Qualification Resolutions (RCAs) have been annulled by the courts.

According to the union, this provision could turn the illegality of an administrative act into a potential financial gain for companies.

The Fenatrama also criticizes the restrictions placed on third-party challenges to RCAs, which would limit access to justice for communities and individuals affected by industrial projects.

The legislation streamlines investment permits, weakens regulatory oversight, and reduces the timeframes and opportunities for public participation and legal challenges.

The Federation welcomed the Constitutional Court’s decision to accept three challenges filed by the opposition against the mega-reform.

Among these is the controversial measure prioritizing the expedited processing of investment plans over the protection of the environment and the country’s natural resources.
