Brazil’s Supreme Court upholds Eduardo Bolsonaro’s conviction

Brasilia, Sep 19 (Prensa Latina) Brazil's Supreme Federal Court (STF) upheld the four-year, two-month prison sentence on former congressman Eduardo Bolsonaro for coercion in proceedings related to the 2022 coup plot.

The decision was reached by the STF’s First Panel, which rejected an appeal filed by the defense team of former President Jair Bolsonaro’s son.

The former lawmaker was convicted for actions carried out in the United States that, according to the Prosecutor General’s Office (PGR), sought to pressure Brazilian authorities and interfere with the judicial proceedings against his father.

The vote cast by the rapporteur, Justice Alexandre de Moraes, was supported by Justices Flavio Dino, Carmen Lucia, and Cristiano Zanin during the trial held via the high court’s virtual plenary session.

The ruling, originally handed down in June, also mandates that the sentence begin under a semi-open prison regime, requires the payment of a 162,000-real fine (approximately 32,400 US dollars), and declares Eduardo Bolsonaro ineligible to run for office for 12 years. According to the charges, the former congressman orchestrated actions from US soil intended to exert pressure and issue threats against STF members and other Brazilian officials, with the aim of preventing a potential conviction of Jair Bolsonaro in the case concerning the attempt to subvert the democratic order.

In his opinion, Moraes upheld that the actions attributed to Eduardo were unrelated to the exercise of his parliamentary mandate and rejected defense arguments regarding freedom of speech and parliamentary immunity.
