Brazil’s indigenous people protest for land rights

Brasilia, May 30 (Prensa Latina) Indigenous demonstrators blocked Tuesday the Bandeirantes highway in São Paulo to protest against the so-called temporary framework, which denies Brazilian indigenous peoples their ancestral lands.

Television footage showed demonstrators burning tires and erecting barriers to block traffic on the highway toward the capital.

According to Record TV, the indigenous people promoted the protest against a bill that hindered the demarcation of indigenous lands. Since 2017, the State has invoked the framework thesis to claim territories.

According to the bill, the Constitution recognizes indigenous people’s rights to lands they occupied as of October 5, 1988. In practice, it limits recognition.

In 2019, the Federal Supreme Court (STF) gave the case a “general repercussion” status. It serves as a guideline for the federal leadership and all justice institutions regarding jurisdictional proceedings.

The temporary framework was established by a decision of the Regional Federal Court for the Fourth Region (TRF-4).

In 2013, it granted to the Environmental Institute of the Southern State of Santa Catarina the recovery of an area located within the Sassafrás Biological Reserve, where the Ibirama-La Klãnõ indigenous land is located.
