In a statement, the Spanish government noted that the Court indicates that treaties on global warming oblige States parties to guarantee the protection of the climate and the environment from greenhouse gas emissions.
It also determines that a State’s failure to comply with its climate obligations constitutes an internationally wrongful act, which may generate an obligation to provide reparations to those affected.
The statement recalled that Spain participated in the proceedings, maintaining that the duty to prevent damage caused by climate change is part of the obligations of States under international law.
At the same time, Spain defended the human right to a clean, healthy, and sustainable environment.
