Milei Enacts, but suspends enforcement of disability law

Buenos Aires, Sept 22 (Prensa Latina) The government of Javier Milei enacted the Disability Emergency Law, which Argentine society has long demanded. However, it suspended its implementation, arguing that Congress must first define the sources of funding.

The law establishes the Non-Contributory Disability Pension for Social Protection, updates the rates of basic benefits, and provides financial compensation to providers, as long demanded by social groups.

However, by decree published in the Official Gazette, the legislation is suspended until Congress determines the sources of funding and includes the corresponding allocations in the national budget, generating further conflict with the legislative palace and leaving a highly vulnerable population without assistance.

The law declares a national emergency regarding disability until December 31, 2026, with the possibility of an additional year extension.

Among its main measures, it stipulates the creation of a Non-Contributory Disability Pension for Social Protection and mandatory access to the Incluir Salud Program, which covers basic and high-cost benefits.

According to the executive decree, full implementation of the law would require more than three trillion pesos, equivalent to 0,35% of the Gross Domestic Product, not including the potential increase in beneficiaries or the expansion of the Incluir Salud Program.

The Casa Rosada alleges a lack of specific funding provided for in the law, as well as insufficient available budgetary credit. It argues that its implementation without its own funds would affect essential services such as security, justice, and prison food.
