Ecuadorian Court declares two of Noboa’s bills unconstitutional

Quito, Sept 27 (Prensa Latina) Ecuador's Constitutional Court declared the National Solidarity Law and the Public Integrity Law unconstitutional, a ruling that Daniel Noboa's government regrets.

The decision, several weeks after the judicial body admitted the lawsuits filed by unions, social organizations, and professional associations was finally taken, thus, the regulations and provisions derived from them are completely annulled.

According to the Court, the National Solidarity Law mixed economic, criminal, and security matters, improperly using the economic emergency procedure.

This legal framework contained definitions for the “internal armed conflict” declared by the government against criminal organizations, reforms to visas for foreign citizens, among other matters.

Meanwhile, the Public Integrity Law, along with its regulations and related rules, violates the principles of unity of subject matter, transparency, and democratic deliberation.

This legislation drew criticism from public officials, whose unions filed more than two dozen lawsuits against it, as it contemplated unfair dismissals and evaluations, among other rules.

In addition, it proposed financial reforms and reforms to the Children’s Code to try minors as adults, a matter that was questioned even by international organizations.

Last August, the Court preliminarily ordered the provisional suspension of several articles of these laws, and since then, President Daniel Noboa and his team have been engaged in an open dispute with the justices.
