Cuba updates identity system with new law

Havana, Jul 30 (Prensa Latina) The National People’s Power Assembly approved the Law on Personal Identity and Domicile, a regulation that guarantees the recognition and protection of the identity of Cuban citizens and foreign residents in the country.

The bill, presented by First Colonel Mario Méndez, updates the personal identity and domicile system, which had been in effect since 2007 with only nine articles, and expands it to a 73-article law that addresses new aspects such as digital identity, domicile registration, and the protection of personal data.

The law is based on Articles 48, 49, and 52 of the Constitution of the Republic, which establish the right of all persons to have their personal identity respected and the inviolability of their domicile.

The head of the Directorate of Identification, Immigration, and Foreign Affairs also explained that the law establishes the scope of the identity system, which covers all Cuban citizens, including those residing abroad who conduct business in Cuba, as well as foreigners residing in the country.

The law defines domicile as the center of a natural person’s legal relationship and establishes the obligation for every person to have a residence as a reference point for their location.

Furthermore, the first colonel detailed that the law regulates Digital Identity as the unique, verifiable, and electronic representation of a natural person.

The bill underwent a consultation process with the deputies, who made proposals that led to modifications in several articles.

Mendez specified that the law will come into effect in three months, instead of the usual six, to coincide with the immigration laws that come into force at the beginning of November.

In assessing these laws, he emphasized that “they complement each other and have an impact on the entire population.”
