Suspension of trial on indigenous lands highlighted in Brazil

Brasilia, Jun 10 (Prensa Latina) The interruption by the Supreme Federal Tribunal (STF) of the controversial trial on the so-called temporary framework that limits the demarcation of lands and weakens indigenous rights, stood out in Brazil.

The new suspension was caused by a request for a hearing by Minister André Mendonça.

According to the internal rules of the STF, the case must return for analysis in a maximum of 90 days.

Before the hearing request, Judge Alexandre de Moraes voted last Wednesday against the time frame.

In 2021, before the stoppage of the trial, Judge Edson Fachin voted against the thesis and the Judge Kassio Nunes Marques manifested in favor.

The superior court judges whether the jurisdiction of native lands should follow the criterion, which defines that indigenous people can only claim their lands occupied before the date of promulgation of the 1988 Constitution.

Currently, there are more than 300 Aboriginal land demarcation processes open in the country.

The natives are against the recognition of such a criterion, while the landowners argue that it is important to ensure legal certainty.
